Rosen, District Attorney SUBJECT: Updated Surveillance Use Policy for Body Worn Camera System RECOMMENDED ACTION Consider recommendations relating to the Office of the District Attorney Bureau of Investigation Body-Worn Camera Surveillance Use Policy. Possible action: a. Adopt finding that the benefits of the surveillance technology outweigh the costs pursuant to Section A40-4 of the Santa Clara County Ordinance Code. b. Approve revised Surveillance Use Policy for Office of the District Attorney Body-Worn Camera System, that has been reviewed and approved by County Counsel as to form and legality. FISCAL IMPLICATIONS There are no direct fiscal implications associated with the approval of this updated Surveillance Use Policy (SUP). Purpose Body-worn cameras (BWC) are small video cameras typically attached to a peace officer”s clothing or tactical vest. They capture, from an investigator's point of view, video, and audio recordings of the investigator's activities, including potential traffic stops, arranged arrests, planned searches, planned arrests or interrogations, and critical incidents such as investigator- involved shootings. They provide documentary evidence for criminal investigations, internal or administrative investigations, and civil litigation. BWCs also provide transparency for the community as well as individual and organizational accountability by building trust and improving conduct.
